Food Standard and Safety Act, 2006 and Nutraceutical regulations under said Act is self-regulated legislative domain. The Food operator has to ensure the safety and quality of food. Nutraceuticals are categorised as a special food segment, and elaborate regulation has been provided. Licensing of Nutraceuticals, Compliance with regulations, change in product composition over time, and the range of food products and composition that may fall in the drugs category are some areas that require diligence and utmost attention. No substance that falls under the definition of the drug can be included in the category of food supplements. Many cases are found where the label claims are responsible for prosecution by the drug department even if the item is food and prepared as per the licensing conditions.
